Your Cozumel Terms and Conditions

   

 

SECURITY DEPOSIT

TENANT agrees to pay $500 usd as a security deposit, it being understood that the security deposit is not to be considered prepaid rent, nor shall any damages claimed (if any) be limited to the amount of the security deposit.  Security deposit is to be held by AGENT and will be returned to TENANT within seven (7) business days of departure if no damages or losses have occurred.  In the case of damages or loss, AGENT will submit to the TENANT an itemized list of any damages claimed to have been caused by the TENANT and return the entire security deposit less damages and other lawful deductions within fourteen (14) days after termination of the lease

 

CANCELLATIONS

We will not be responsible for, yet not limited to, the following: Acts of God, Medical Emergencies, Accidents, Airline Problems, etc. It is recommended to acquire travel insurance to protect yourself against such situations.

 

If the reservation is cancelled 46 or more days in advance of arrival, 50% of the deposit amount will be forfeited. If the reservation is cancelled between 31 to 45 days before arrival, 100% of deposit will be forfeited. If the reservation is cancelled 30 days or less in advance of arrival, 100% of the full rental amount, less the security deposit and 14% tax, will be forfeited.

 

LOSSES AND DAMAGES

TENANT will be responsible for all damage and loss to the property caused by TENANT during his stay and will be required to keep the property secure and locked at all times.  TENANT will be charged $20 usd for each key not returned to AGENT, the rental management company.  TENANT agrees to surrender the property in the same condition as at commencement of the rental period and agrees to be responsible for excessive cleaning, repair and housekeeping expenses caused by TENANT or Guests.  An inventory and inspection will occur the expiration of the lease term, and TENANT agrees to be charged after the rental for additional repairs and charges due to accidental damage or breakage in excess of $10 usd, missing items, towels, sheets, DVDs, etc., or damages to the property or common areas.  Neither AGENT nor the Property Owner that is the subject of this rental agreement shall be held responsible for missing or stolen property of TENANT and Guests.  TENANT and Guests are asked to use the property safes to store money, tickets, travel documentation, jewelry and other valuables.

 

THINGS BEYOND OUR CONTROL

AGENT will do everything possible to make sure your stay is happy and comfortable.  The house is leased according to the inclusions and information published on the Your Cozumel website; however, there are things that are out of our control.  Please understand that there will be no refunds or discounts offered or expected.  Examples of these types of things that are beyond our control include a breakdown of air conditioners, TVs, DVD players, electronics and appliances, lack of access to Internet services, beach or pier access unusable due to acts of nature, bad weather, disturbances by neighbors, or beach access location.  AGENT will make every effort to immediately remedy any problem with the home that is within its control.

 

RESPONSIBILITIES FOR CHILDREN/MINORS

Adults traveling with children and minors are solely responsible for them.  There is no life guard on duty at the pool, beach or hot tub.

 

TENANT AGREES TO THE FOLLOWING:

 

1)        No more than 9 people will occupy said premises. 

2)       The TENANT shall leave the house in good condition.  All furniture and accessories will be left as they were found.

3)       The TENANT will not remove bath towels from inside the home.

4)       If the TENANT defaults/or otherwise fails to comply as regards to any item in this lease, the TENANT agrees to vacate said premises upon receipt of proper notification from AGENT.

5)       The TENANT agrees to allow AGENT to enter and view the premises:

(a)      To inspect the premises

(b)     To make repairs

(c)     To perform maid service.

6)       AGENT agrees to keep the property in good repair and to supply fixtures and household furnishings.

7)       AGENT and the TENANT state that the rental of these premises is for vacation or recreational purposes.

8)       The TENANT shall not allow smoking inside the home at any time.

9)       Release of the security deposit is subject to the following provisions:

(a)      Expiration of the full term of lease

(b)     No damages to the property beyond normal wear and tear

(c)     At anytime during the term of this lease, if  AGENT suspects there has been smoking inside the home, the $500 usd security deposit will be held in full and not refundedDetermination of whether smoking has occurred in the house is at the sole discretion of AGENT.

10)   TENANT will resolve any disputes under Mexican Law.  The municipal court of the city of Cozumel, State of Quintana Roo, Mexico, will have complete and absolute jurisdiction regarding any legal action.

 

 

RELEASE AND HOLD HARMLESS AGREEMENT

As a condition of renting the property that is the subject of this rental agreement, I agree to the following Release and Hold Harmless Agreement on behalf of myself and all occupants and guests who are subject to this rental agreement. I hereby waive, release, hold harmless, and forever discharge Bird is the Word S de RL de CV, its employees, agents and/or representatives, the owner of the rental property that is the subject of this rental agreement, its employees, agents and/or representatives, and any and all entities responsible for the common grounds of the property known as Villas Costa del Sol from any and all claims I may have or which may accrue against me for any and all direct, indirect, special or consequential damages, costs, legal or otherwise, arising from and/or related to my use and rental of the property which is the subject of this rental agreement. This Release/Agreement shall be binding on all those occupants and guests of the rental property related to this rental agreement and on my heirs, administrators, executors, and assigns.

 

In signing this release, I acknowledge and represent that I have read the foregoing Release and Hold Harmless Agreement, understand it, and sign it voluntarily as my own free act and deed; no oral representatives, statements or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this release for full, adequate, and complete consideration fully intending to be bound by same.
